- Product Descriptions: We strive to display product colors, features, specifications, and availability as accurately as possible. However, we do not guarantee that your monitor’s display is accurate. All products are subject to availability. We reserve the right to discontinue any product at any time.
- Pricing: All prices listed on the Site are in Canadian Dollars (CAD) unless otherwise stated. Prices are subject to change without notice. We are not responsible for typographical errors regarding price or product information. In the event of an error, we reserve the right to cancel any orders placed for the incorrectly priced item and will notify you of the cancellation.
- Orders: When you place an order, you are making an offer to purchase the product(s) subject to these Terms. We may accept or decline your order for any reason. Your order is not accepted until we send you a shipping confirmation email. Any products on the same order which we have not confirmed in a shipping confirmation email do not form part of that contract.
- Shipping & Taxes: Shipping costs and estimated delivery times are outlined in our separate Shipping Policy. You are responsible for any applicable sales taxes, goods and services taxes (GST/HST), customs duties, or other governmental charges related to your purchase, as required by law.
5. Payment Terms
We accept various payment methods as indicated at checkout. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including shipping and taxes). All payments shall be processed in accordance with our and our payment processor’s policies. In the event we are unable to charge your chosen payment method, we reserve the right to cancel your order.

All content on the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and the overall “look and feel” of the Site, is the property of Simple Daily Store or our content suppliers and is protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

- Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL SIMPLE DAILY STORE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCTS PROCURED USING THE SITE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOST REVENUE, LOST DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED CANADIAN DOLLARS (CAD $100) OR (B) THE AMOUNT YOU HAVE PAID TO SIMPLE DAILY STORE FOR THE PRODUCTS GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
11. Indemnification
You agree to indemnify, defend, and hold harmless Simple Daily Store and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your violation of the rights of a third party.
12. Termination
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services or by ceasing to use our Site. We may suspend or terminate your access to the Site and Services, delete your account, and/or prohibit future use of the Site at our sole discretion, without notice or liability, for any reason, including if we believe you have violated these Terms.
13. Governing Law and Dispute Resolution
This Agreement and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement will be brought exclusively in the provincial or federal courts located in Halifax, Nova Scotia, and you hereby irrevocably consent to the personal jurisdiction and venue therein.
14. Entire Agreement & Severability
These Terms, together with our Privacy Policy, Refund and Returns Policy, and Shipping Policy, constitute the entire agreement between you and Simple Daily Store regarding the use of the Site and supersede all prior agreements and understandings. If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
